My next step? I call directly to Freddie Mac at 800-373-3343, since they are the owners of the loan. A lady answer, I explain the situation, she said you need to wait as they told you 2 weeks to 30 days, then call us back, if they haven’t changed the information then, we will open a case number. I said no! I will not wait even 1 day, I want you to open a case right now. This needs to be resolved before the end of the month so that when I call to make my February 1st payment, they already have the correct information. I was very aggressive and I demanded the case to be open at that moment. She was probably a lazy person who didn’t want to do her job. This is exactly what you need to do, do not listen to anyone that tells you to wait. This is your house and no one really cares about it. You have rights.
The lady opened a case, she gave me a case number and said that they will contact Green Tree regarding my situation. She said we will contact you within 7 business days. I said ok.
I waited 4 business days and I called Green Tree Servicing again to find out if they had changed the payment information. They had done it, the system now said: your February 1st payment is due on February 1st.
On January 27 at 11:45 am I received I call from a very nice gentlemen from Freddy Mac. He ask for me and asked me some question to verify that I was the person he need to talk to. He said: My name is John Paul form Freddy Mac and I am the person in charge to take care of the complaints against Green Tree. Tomorrow I have a conference tomorrow with them regarding your case and I need to know if they still have not change your payment information. I said they did change it, and I am sure they did so because you contact them.
He said I am glad your problem was resolved. I asked him if I had any kind of problem with this servicer in the future can I always call you for help? He said of curse, give us a call and we will take care of it. Ok, I said, thank you so much for your help.
On January 24th I had received the Respa Transfer Letter from Green Tree. By law they have to send it to you within 15 days from the transfer date. The most important thing about this letter is that it gives you the Loss Pay Information for your fire insure policy, this is extremely important. Even though your insurance agent needs to do it, you can’t relay on someone else to do something this important. Please read the following article regarding the changes that need to be made to your evidence of insurance and where to send it. If you don’t do this, Green Tree or any lender will force their insurance which is very expensive, this will cause your escrow shortage big time, therefore your payment will go up because of it.
